LEGAL SOLUTIONS:

Legal Solutions is an initiative developed by Stand Up Canada as a result of COVID-19 measures.


PURPOSE:

In a free and democratic society, the power belongs to the people.  As such, the purpose of this initiative is to put the power back in your hands during COVID-19.  We want to help you to protect, defend and use your civil rights.  We are assisting YOU by offering different legal information packages listed below for a donation to Stand Up Canada in the amount of $25, $50, $75 or $100.


We are living in unprecedented times.  People have lost their jobs.  Businesses have gone under.  Please pay what you can afford.  If you cannot afford a $25 dollar donation, reach out to us at info@standupcanada.solutions and we will sponsor you for free. Want to donate one to someone?  Wonderful!  You can do that as well...Our goal is to empower you to take a legal stand.  Your legal win is everyone's.

We are offering three different legal information packages to help you find solutions(s) that apply to your circumstance. 

#1. Represent Yourself in Small Claims Court (for businesses - damages due to lockdown measures)

#2. Represent Yourself in Provincial Offences Court (for businesses - tickets for staying open)

#3. Represent Yourself - Refusal of Mask Exemption (for individuals - tickets/employment issues)

LEGAL INFORMATION PACKAGE #3 - Represent Yourself - Refusal of Mask Exemption

Have you been affected by the following scenarios?

  • Are you someone who was denied service in a retail setting because you would not wear a mask due to your beliefs (creed)? And/or were you issued a ticket in this circumstance?
  • Are you someone who was denied service in a retail setting because they refused to honour the bylaw mask medical exemption? And/or were you issued a ticket in this circumstance?
  • Are you an employee whose employer refuses to respect your medical exemption or exemption based on creed (your beliefs)?

 

This legal information package is intended for you to:

(i) file a Human Rights Complaint under the protected grounds of creed and/or disability under The Ontario Human Rights Code; and/or

(ii) challenge/fight the Ontario provincial government in Provincial Offences Court for any tickets issued to you as a result of not wearing a mask in retail settings; and/or

BACKGROUND:

  • Nirmala Armstrong has a Specialist Degree in Political Science from the University of Toronto, an LLB Degree from Queen’s University Faculty of Law, and an LLM Degree from Osgoode Hall Law School
  • She has served as a legal advisor to many volunteer community services and Non-for Profit Organizations as part of her passion for serving the community and facilitating access to justice in various capacities
  • Nirmala has acted both in her legal and political capacities to help those in need; she is a compassionate advocate for Human rights issues, exemplified by her involvement in helping to organize Domestic Violence Awareness rallies in York Region


HUMAN RIGHTS ADVOCATE: 

  • She has passionately advocated and has helped organizations raise donations towards programs and accessibility equipment/services for adults and children with mental and/or physical disabilities
  • She also values protecting vulnerable populations such as seniors, whereby she has helped get seniors access to affordable housing, financial aid, and access to resources
  • She has also brought businesses together in York Region to help address homelessness by opening avenues and opportunities for homeless youth


COMMITMENT TO COMMUNITY:

  • Nirmala continuously assists community service organizations with their growth, i.e., organizational, administrative, and fundraising
  • Some examples of her community service involvement include: Nirmala was the past Chairperson of the Markham Arts Council and past-President of Markham Unionville Rotary Club; Nirmala has also served as a Director for the Equity Council in York Region as well as the Social Services Network and as a Chair for Multicultural and Anti-Racism Community Organization; in addition, she has been a member of the Markham African Caribbean Canadian Association, Markham Unionville Rotary Club, and Markham Lions Club 


POLITICAL ENGAGEMENT:

  • In recognizing there are other routes to make impactful changes, she ran for the municipal election of 2014 where she was the first South-Asian woman to be elected as Regional Councillor for the City of Markham and York Region; during her time as a Regional Councillor, she continued and expanded her community involvement
  • She was the Co-Chair of the York University Markham Campus Sub-Committee; she has also participated in the Advisory Committee on Accessibility, the Budget Committee, the Eabametoong First Nations Committee, the Mayor’s Youth Council, the Seniors’ Advisory Committee, the Train Anti Whistling Working Group, the Markham Sports Hall of Fame, the Smart Commute Markham Richmond Hill Committee, and several other committees


 OUTSTANDING ACHIEVEMENTS:

  • Her most notable achievement was in 2002 where Nirmala was a recipient of the Queen’s Golden Jubilee Medal and later received the Queen’s Diamond Jubilee Medal in 2012, commending her outstanding community service (well done Nirmala!)
  • Nirmala has also been a recipient of the Inspiring Women Award from ANGEENA International Non-Profit Organization, the Award of Excellence from Council of Agencies Serving South Asians, the Award for Leadership and Support from the South Asians Gift of Life Committee in Collaboration with the City of Markham, and an Award of Appreciation from Carrom Canada; she further received a special Thank You Award from the domestic violence shelter, known as Yellow Brick House, for her passion and commitment to helping the victims of domestic abuse (your dedication to being a champion for human rights is so commendable - thank you Nirmala!)
